Terms of Service

These Terms are an agreement between you and Yuhao Jian, trading as Phantom Helix, an Australian sole trader, ABN 52 512 969 796 ("Phantom Helix", "we", or "us"). By accessing or using a covered service, you agree to these Terms. If you use a service for an organization, you also represent that you have authority to bind that organization.

The Acceptable and Responsible Use Policy is incorporated into these Terms. A separately accepted order, data processing addendum, or written agreement controls to the extent it expressly conflicts with these Terms.

Phantom Agent is a professional B2B investigation service. Its users must be at least 18 years old and act for a business, organization, public-interest body, or independent professional practice. You must provide accurate account and access-review information and use the service for a lawful professional purpose.

SIERRA Desktop and public website resources may also be used for lawful personal research where the relevant product page permits it. That does not expand eligibility for Phantom Agent or remove any authorization, privacy, contract, or source-use obligation.

Subject to these Terms, Phantom Helix grants you a limited, non-exclusive, non-transferable, revocable license to use the covered software and services for their documented purpose. You may not resell, sublicense, rent, or redistribute a service unless a separate written agreement permits it.

Features may require an account, verified email, approved preview access, compatible local software, an available paid balance, or a third-party credential. You are responsible for credentials, sessions, API keys, scripts, and activity performed through your account.

You retain your rights in content you submit. You give Phantom Helix the limited rights needed to host, transmit, reproduce, transform, and otherwise process that content to provide, secure, support, and comply with law in relation to the service. You represent that you have the rights and authority needed to provide the content and issue those instructions.

For B2B investigation content, the customer normally determines the purpose and means of the investigation and is responsible for its legal basis, notices, source terms, and handling of results. Phantom Helix normally processes that content on the customer's instructions to provide the service.

Phantom Helix does not use investigation content to train or fine-tune models, evaluate or optimize models or prompts, or conduct general human quality review. Routine support access to investigation content requires the account user's express authorization for the specific issue and run.

You may use investigation and security tooling only for data, accounts, systems, and subjects you own, are permitted to assess, or are otherwise legally authorized to investigate. Public availability of information does not by itself establish a lawful purpose or permit every form of collection, profiling, disclosure, or contact.

You must not:

• use a service for unlawful access, credential theft, stalking, harassment, doxxing, fraud, discrimination, intimidation, evasion, or other abuse;
• deploy active security techniques, payloads, scanning, or exploitation outside a documented authorized scope;
• bypass rate limits, access controls, billing, safety controls, provider restrictions, or technical boundaries;
• use output as the sole basis for employment, credit, insurance, housing, immigration, medical, or law-enforcement decisions; or
• investigate a minor unless the work has a documented protection purpose or clear legal authorization.

AI-generated text, tool results, source extracts, scores, reports, and graph relationships may be incomplete, outdated, ambiguous, or wrong. They are leads and analysis aids, not verified facts or professional advice. A qualified person must review material findings, underlying sources, identity resolution, dates, and context before acting.

Phantom Helix does not guarantee that a source is available, lawful for every purpose, complete, or accurate. You are responsible for decisions, disclosures, contact, and other actions taken from the output.

The services rely on hosting, authentication, model, payment, analytics, security, email, and data providers. Cloud Invokers and capabilities may send request fields to an external API, website, registry, or source needed to perform the selected task. Those services may operate in other countries and under their own terms and privacy practices.

The current categories and core services are described in the Service Providers and Research Sources directory. You are responsible for any separate third-party account, credential, license, and use restriction that applies to your request.

Phantom Helix may offer free downloads, paid plans, and prepaid or usage-linked balances. Prices, plan features, token allotments, and packages may change prospectively. Unless the checkout terms or applicable law say otherwise, payments are non-refundable.

Stripe processes payments. Full card numbers and CVCs do not reach Phantom Helix. Fraud, charge disputes, promotional abuse, or attempts to evade billing controls may result in suspension while the issue is reviewed.

The Privacy Policy explains current collection, storage, cloud processing, providers, international transfers, sharing, retention, support access, and privacy request procedures. Local SIERRA content stays on the user's device by default; Helix, Phantom Agent, and user-invoked cloud features process data as described in that policy.

We may limit, suspend, or terminate access when we reasonably believe a user violated these Terms, created risk for people or systems, exposed a provider or the service to liability, failed to pay, or engaged in fraud, abuse, or unlawful conduct. Where appropriate, we may investigate and ask for additional authorization or scope information.

Termination does not automatically erase every record. Data is handled according to the Privacy Policy, applicable product deletion controls, and legal or business-record obligations.

The services are provided "AS IS" and "AS AVAILABLE." To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and accuracy. Nothing in these Terms excludes a guarantee, right, or remedy that cannot lawfully be excluded.

To the fullest extent permitted by law, Phantom Helix is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profit, revenue, goodwill, data, or business opportunity arising from use of the services. This limitation does not apply where liability cannot lawfully be limited.
